BC Strata Leak Bylaws: What Every Owner and Council Member Should Know

Guide to BC strata bylaws related to water leaks, detection, maintenance obligations, and cost recovery.

Strata bylaws modify how leaks are handled beyond the Strata Property Act. Understanding your bylaws is essential for both council members and owners when dealing with water leaks.

Standard bylaws place common property responsibility on strata and strata lot responsibility on owners. Many BC strata have adopted bylaws modifying this framework, shifting responsibility for certain leaks.

Bylaws commonly address: deductible recovery, owner maintenance obligations, notification requirements, right to enter for investigation, cost recovery for detection, and repair requirements.

Insurance deductible recovery has been a major source of dispute. Under Section 158 SPA, strata can recover from an owner responsible for the loss. Some bylaws establish presumption of responsibility if leak originates from a unit.

Review your bylaws with legal counsel. If your strata lacks specific leak-related bylaws, consider adopting them with advice from a strata law specialist.
